VoteByMail Privacy Policy

VoteByMail is a service provided by FIE Business GroupLLC. FIE Business GroupLLC is committed to protecting the privacy of our visitors and users. This privacy policy explains in depth what information is collected and how it’s used.

VoteByMail collects personal information in order to keep users informed of updates about voting. Note: We use Vote.org’s tools to help users register to vote and request mail-in ballots (you can read their Terms here and Privacy Policy here).

We take great care to ensure that the information that is collected remains private. We do not sell our user information, nor do we distribute any personal user data for any purpose other than providing you with the voting information and services you have requested.

Information we gather

 

WHEN YOU VISIT VOTEBYMAIL’S SITE

VoteByMail uses Google Analytics to monitor user traffic and visitor trends on the VoteByMail website. When you visit the VoteByMail website, we record basic information such as your IP address, referral source, browser type, and the date and time of your visit. We use this data only on an aggregate basis – for example, to know which pages are most popular or how many people visit the site on a given day. This information helps us improve the VoteByMail site and our voter services. We do not link this information to your VoteByMail account or identity.

WHEN YOU SIGN UP FOR VOTEBYMAIL SERVICES

When you register for an account or use VoteByMail to fill out a voter registration or ballot request form, we do store personally identifiable information, including your name, address, email address, and other identifying information.

COOKIES

Cookies are small pieces of data stored on your computer for a prolonged period of time that make VoteByMail easier to use by saving your status and preferences. We use session cookies to keep track of the information you enter while you fill out a voter form. To simplify registration and login, we may use cookies to recognize when you return to VoteByMail. Most browsers are initially set to accept cookies, but you may be able to change the settings to refuse cookies or to be alerted when cookies are being sent.

DISCLOSURE OF INFORMATION

We may disclose personally identifiable information about you to third parties in limited circumstances, including: (1) with your consent; or (2) when we have a good-faith belief it is required by law, such as pursuant to a subpoena or other judicial or administrative order.

If we are required by law to disclose the information that you have submitted, we will attempt to provide you with notice (unless we are prohibited) that a request for your information has been made in order to give you an opportunity to object to the disclosure. We will attempt to provide this notice by email if you have given us an email address, or by postal mail if you have entered a postal address. If you do not challenge the disclosure request, we may be legally required to turn over your information.

In addition, we will independently object to requests for access to information about users of our site that we believe to be improper.

THIRD-PARTY SERVICE PROVIDERS

VoteByMail works with third party service providers and partners to send you forms and reminders, and to otherwise assist us in providing our service to you, and we transmit your information them for these purposes. We do not share any information with these service providers or partners beyond what is necessary to provide you with their services.

We do not sell your information and neither do our service providers or partners.

VOTEBYMAIL PARTNER ORGANIZATIONS

If you’re signing up via one of our partner organizations, this partner also has access to your personal data and general information about the services we provide you, and may contact you separately. Our partners are committed to your privacy and do not sell your information.

Security

VoteByMail uses industry-standard security measures to protect the information you provide to us. Information you submit is encrypted through a Secured Socket Layer (SSL) connection, which protects the data in transit. We also encrypt all communication with our mail services provider to ensure that your data remains secure when transmitting voter forms to be printed.

Although we make good faith efforts to store information securely, we cannot guarantee complete security. VoteByMail shall not be responsible for any harm that you or any person may suffer as a result of a breach of confidentiality of any information you transmit to the VoteByMail site.

Updating or Removing Your Information

You may choose to correct, update, or delete the user information you have submitted to us. However, please understand that deleted information may persist in our backup files.

Children’s Privacy

VoteByMail is intended for voting-age adults and we do not knowingly collect personal information from children under 13 years of age. If you are a parent or legal guardian of a child under age 13 who you believe has submitted personal information to us, please contact us immediately at info @ VoteByMail.org.

Welcome to VoteByMail, a project of FIE Business GroupLLC. (“VoteByMail”). VoteByMail makes it easy to vote and register using Vote.org‘s voter registration tools. Services include but are not limited to using Vote.org’s tools to facilitate your completion of ballot request forms or voter registration forms for your state (the “Services”).

To provide the Services, we have to set out some ground rules for using the Site in this document (the “Terms”). By accessing, using, or contributing to the Services or the Site, and in consideration for the Services we provide to you, you agree to abide by the Terms.

VoteByMail may change the Terms from time to time, at VoteByMail’s sole discretion. Your continued use of the Site following the posting of such changes will constitute your assent to all such changes. Please periodically visit this section of the Site to review the current version of the Terms.

VoteByMail make no warranties or representations about the Site or the Services, including but not limited to accuracy, reliability, completeness, timeliness or reliability. Nor can VoteByMail guarantee that the Site and the Services will be kept available or updated—VoteByMail reserves the right to change, suspend, or discontinue all or any part of the Site or the Services at any time without prior notice or liability.

VoteByMail never submits forms on your behalf. VoteByMail only uses Vote.org’s tools to help you complete your voter registration forms. VoteByMail is not a voter registration drive. VoteByMail does not provide or replace individualized legal or electoral advice. The Site and the Services may include information which is out-of-date, jurisdiction-specific, or applicable only based on a specific set of facts and that not apply to your situation. Use of the Services or Site does not create an attorney-client relationship between the user and the VoteByMail. If you are in need of legal advice, seek individual attorney advice and do not rely on VoteByMail. VoteByMail is not your lawyer, agent, or representative for any purpose.

The information on this Site is provided free-of-charge, and we accept no liability for this Site and the information on this Site. Our liability is limited and excluded to the maximum extent permitted under applicable law.

Disclaimer of warranty and limitation of liabilities

REGISTRATION

To utilize the Site and Services, or certain portions thereof, you may be required to complete a registration process and establish an account with VoteByMail (an “Account”). You represent and warrant that all information provided by you to VoteByMail is current, accurate, and complete, and that you will maintain the accuracy and completeness of this information on a prompt, timely basis.

USE VOTEBYMAIL LEGALLY

You acknowledge that information you provide will be used by Vote.org to generate forms and applications that you may then submit to state and local government agencies. Providing false information to government agencies is illegal. It is your duty to comply with all federal, state, and local laws. You agree that you will not use VoteByMail’s website as part of an attempt to register to vote falsely, register to vote more than once, register to vote when you are not eligible, request more than one absentee ballot, request an absentee ballot when you are not eligible, commit any other type of election fraud, or violate any other federal, state, or local laws.

PASSWORD AND SECURITY

As a registered user of the Site and Services, you may receive or establish one or more passwords. You are solely responsible for maintaining the confidentiality and security of your password(s) and VoteByMail Account(s). You understand and agree that you a fully responsible for all actions made from your VoteByMail Account(s). Any accounts you create are not transferrable. You agree to notify the VoteByMail immediately if you become aware of any unauthorized use of your VoteByMail Account(s).

PRIVACY

VoteByMail respects the privacy of our users. The Privacy Policy [Link to Privacy Policy] is expressly incorporated herein by reference and made a part of these Terms. Termination: VoteByMail reserves the right to terminate your VoteByMail Account(s) or restrict access to your VoteByMail Account(s), or to delete any information stored in your VoteByMail Account(s), with or without notice, for any or for no reason, and without any liability to you.

 

Access to and use of the site

 

ACTS AGAINST THE SITE/SERVICES

You shall not attempt or engage in potentially harmful acts that are directed against the Site or Services including, without limitation, the following:

  • Using the Site or Services in contravention of any other agreement to which you are a party, including without limitation any employment agreement to which you may be a party
  • causing, allowing, or assisting any other person to use your VoteByMail Account(s) or impersonate you
  • sharing your password or login with any other person
  • logging onto a server or VoteByMail Account(s) that you are not authorized to access
  • forging user names, manipulating identifiers, or otherwise impersonating any other person or misrepresenting your identity or affiliation with any person or entity
  • emulating or faking usage of the Site or Services
  • violating or attempting to violate any security features of the Site
  • using manual or automated software, devices, scripts, robots, or other means or processes to access, “scrape, ”“crawl, ”or “spider ”any pages contained in the Site
  • introducing viruses, worms, software, Trojan horses, or other similar harmful code into the Site or Services
  • interfering or attempting to interfere with the use of the Site by any other user, host, or network, including without limitation by means of submitting a virus, overloading, “flooding, ” spamming, ” mailbombing, ” pinging, ”or “crashing ”the Site
  • causing, allowing or assisting machines, bots, or automated services to access or use the Site or Services without the express written permission of VoteByMail
  • tampering with the operation, functionality, or the security of the Site or Services
  • attempting to override or circumvent any security or usage rules embedded into the Site or Services that permit digital materials to be protected
  • attempting to probe, scan, or test the vulnerability of the Site, or any associated system or network, or breach any security or authentication measures
  • misusing, tricking, disrupting, or otherwise interfering with the functioning of the Site or Services
  • harvesting or collecting email addresses or other contact information of other users or clients from the Site by electronic or other means
  • reverse engineering, decompiling, disassembling, deciphering, or otherwise attempting to derive the source code for any underlying intellectual property used to provide the Site or Services
  • engaging in “framing, ” mirroring, ”or otherwise simulating the appearance or function of the Site
  • forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

Violations of system or network security may result in civil or criminal liability. You agree that it is your responsibility to install anti-virus software and related protections against viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines or engines that are intended to damage, destroy, disrupt, or otherwise impair a computer’s functionality or operation.

PARENTAL NOTICE

Pursuant to 47 U.S.C. Section 230(d) as amended, VoteByMail hereby notifies you that parental control protections (such as computer hardware, software, or filter services) are commercially available that may assist you in limiting access to material that is harmful to minors. Information identifying current providers of such protection is available on the Internet (e.g., http://en.wikipedia.org/wiki/List_of_content-control_software).

INFORMATION YOU PROVIDE

Information you provide to the Site, including your name, address, email addresses, and other identifying information, should be relevant to the subject scope of VoteByMail. Information you provide may not be false, misleading, illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable.

VoteByMail does not pre-screen or regularly review information you provide, but VoteByMail has the right (though not the obligation) to remove, without notice, any information you provide which VoteByMail considers, for any reason, to violate these Terms or to be outside the subject scope of the Services. VoteByMail may terminate any VoteByMail Account, with or without notice, for providing such information.

USER REPRESENTATIONS AND WARRANTIES

By providing information and/or content to VoteByMail, you represent and warrant that you have all right, title, and interest to such information, including but not limited to any consent, authorization, release, clearance or license from any third party (such as, but not limited to, any release related to rights of privacy or publicity) necessary for you to provide, post, upload, input or submit the information and/or content, and your provision of the information and/or content does not violate any federal, state, or local law. You further represent and warrant that providing such information and/or content does not violate or constitute the infringement of any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right recognized by any applicable jurisdiction of any person or entity, or otherwise constitute the breach of any agreement with any other person or entity. You further represent and warrant that you are who you say you are, that you have not submitted fictitious, false or inaccurate information about yourself, and that all information and/or content provided is true and your own information, and that the provided information and/or content does not contain any threatening, harassing, libelous, false, defamatory, offensive, obscene, or pornographic, material, or other material that would violate any other applicable law or regulation. You agree that you will not knowingly and with intent to defraud provide material and misleading information and/or content. You represent and warrant that the information and/or content you supply does not violate the Terms.

INDEMNITIES

You agree to defend, indemnify, hold harmless, and defend VoteByMail and its licensors, suppliers, officers, directors, employees, agents, affiliates, subsidiaries (collectively “Indemnified Parties”) from and against any and all liability, loss, claim, damages, expense, or cost (including but not limited to attorneys’ fees), incurred by or made against the Indemnified Parties in connection with any claim arising from or related to your use of the Site, the placement, posting or transmission of any messages, information, software, content or other materials on or through the Site by you or users of your account, or any breach or violation of these Terms of Use by you or users of your account. You agree to fully cooperate as reasonably required by any Indemnified Party(ies). Each Indemnified Party may, at its own expense, assume the exclusive defense and control of any matter for which it is indemnified hereunder. You shall not settle any matter without the consent of the applicable Indemnified Party.

MODIFICATIONS

VoteByMail reserves the right to change, at any time, at our sole discretion, the Terms under which these Services are offered. You are responsible for regularly reviewing the Terms. Your continued use of the Site and Services constitutes your agreement to all such Terms.

TERMINATION OF SERVICE

VoteByMail disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services or Site, or any software provided through the Site. VoteByMail reserves the right to modify, suspend, or discontinue the Services or access to the Site without any notice at any time and without any liability to you.

SCOPE OF TERMS

The Terms apply to use of and contribution to the Site and any account provided therefore. FIE Business GroupLLC may operate additional projects or services which require separate or additional terms. Such different terms are made available through the individual project or service and are not addressed further herein.

NO WAIVER OF TERMS

Failure of VoteByMail to exercise or enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in that or any other instance.

GOVERNING LAW AND ENTIRE AGREEMENT

These Terms are governed by the laws of the State of Florida, without regard to the rules of conflict of law that may cause the laws of another jurisdiction to apply. You agree to the sole and exclusive jurisdiction and venue of the federal or state courts serving the State of Florida in the event of any dispute of any kind arising from or relating to the Site or Services, or your use or review of it. The Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of the Terms will continue in full force and effect.
